VIRGINIA LEGAL INFORMATION

Witnesses: A living will in Virginia can be witnessed by "any person over the age of 18, including a spouse or blood relative of the declarant. Employees of health care facilities and physician's offices, who act in good faith, shall be permitted to serve as witnesses." Virginia Code Section 54.1-2982.

Who may be a witness? Virginia law restricts only the spouse and a blood relative of the declarant from serving as witnesses to a Virginia living will. See Virginia Code Section 54.1-2984.

Notary: There is no express provision in the Virginia statutes requiring that a living will be notarized; however, it is highly recommended that your living will be notarized to ensure that it is accepted by medical personnel in an emergency situation;

Must health care agent sign form? No requirement that health care agent sign form;
