Power of Attorney Statutes
- Notary: The signature of the principal and both witnesses upon a POA must be acknowledged by a notary.
- Witnesses: There must be two witnesses to the signature of the principal, neither of whom is (a) under 18 years of age, (b) the attorney-in-fact, (c) related to the principal by blood or marriage, or (d) related to the attorney-in-fact by blood or marriage.
- Signature of Agent: No requirement that the agent sign the POA; however, the standard MedLawPlus.comŽ POA form does have a signature block for the agent. It is a recommended practice to have the agent (also called "attorney-in-fact") sign the POA.
