PERSONAL REPRESENATIVE

The term "Personal Representative", also called "executor" in some states, is the person named by the probate court to administer the estate of a decedent. A "decedent" is a person who has died. In cases where the decedent has not named a personal representative in his or her will, the court appoints a Personal Representative for the estate. Generally, the duties of a Personal Representative are to:
(a) prepare an inventory, and take control, of all assets of the decedent,
(b) manage the assets of the decedent until the estate is closed,
(c) pay all the expenses and debts of the estate,
(d) prepare the decedent's final income tax return,
(e) prepare any tax returns required by the estate, and
(f) distribute the assets of the estate as required by the decedent's will or otherwise as directed by the court.
