"Health Care Agent" is the individual you designate in this agreement to make health care decisions on your behalf if two events occur: (1) your attending physician determines that you are no longer able to understand, appreciate, and direct your medical treatment and (2) two physicians--one of whom is your attending physician and the other is qualified and experienced in making such diagnosis--have personally examined you and have diagnosed and documented in your medical records that you are either terminally ill or that you are in a state of persistent unconsciousness with no reasonable expectation of recovery. This means the Health Care Agent cannot make decisions on your behalf unless these two conditions are present.
The Health Care Agent you designate is directed to follow all directives you give in Part II of this document regarding the types of treatment you desire to withhold in case where the agent can act (i.e., where cases (1) and (2) above exist). To the extent your wishes are unknown, your Agent shall make health-care decisions for you in accordance with what your Agent determines to be in your best interest. In determining your best interest, your Agent shall consider your personal values to the extent known to the agent. Also, if you give the Agent the power in Part III of this document, the Agent may also make decisions regarding donation of your organs for transplant.
The "successor health care agent" is an individual who serves in place of the original health care agent when the original is unable or unwilling to serve. When the successor steps in place of the original health care agent, the successor serves with the same powers and duties and the original.
