PERSONAL EFFECTS

The definition used in this will form for "personal effects" is as follows: Items of clothing, jewelry, mementos, personal papers, awards, photographs, and other similar items owned by the maker of the will at the time of his or her death except that no single item shall be included in this category if it has a fair market value in excess of $500. Any item falling within the above description having a value in excess of $500 shall either be covered by a specific bequest in the will or, if not, fall into the residuary category by which the remainder of the estate is disposed.

Although the choices for personal effects in the questionnaire do not include a selection that allows you to name specific items to go to specific individuals (i.e., my gold watch to my grandson Joey), this may be accomplished as follows. First, state in response to personal effects question how you desire all of your other personal effects to be distributed. Then, in response to next question, state the specific individual you wish to have an item that falls within our definition of "personal effects". Any designation you make for specific item of your property will override the general selection for distribution of personal effects.

If you select the final option in response to the personal effects question, you must name the individuals you wish to share your personal effects. If you name more than one person, each person named will receive an equal share. If you name only one person, that person shall receive 100% of your personal effects.
