Alleged Improper Refrigerator Installation

The Complaint. The law firm of Simon Passanante has filed a lawsuit in St. Clair County, Illinois circuit court against Sears Roebuck and Company alleging that a class of Sears customers were damaged through "defective and improper installation of the refrigerator ice-makers and water dispensers it sells in Illinois." Complaint, page 1. It is further alleged in the complaint that Sears directs various agents in installing refrigerators with ice-makers to use self-piercing type shut-off valves, "saddles" or "saddle valves." Complaint, para. 5. "Self-piercing type shut-off valves, 'saddles' and 'saddle valves' are prone to reduce water flow, and to become clogged and leak. When self-piercing type shut-off valves, saddles and 'saddle valves' leak, they are likely to cause damages to the homes, businesses and real property and personal property of customers. Sears' installations of its refrigerator ice-makers, as described above, violate the Illinois State Plumbing Code." Complaint, para. 14-16. The case is Bradley v. Connecticut, Florida, Massachusetts, Minnesota, New Hampshire, North Carolina, Ohio, Virginia, and Vermont are other states which have plumbing codes prohibiting use of saddle valves for the installation of refrigerator ice-makers. Other large appliance retailers such as Home Depot, Lowe’s or Best Buy may also have installed saddle valves in this fashion.
