Question: I am a physician that wants to practive under an LLC. Can I do this in IL as a single member. If I want to add additional members do they have to be physicians?

Response: Yes, a physician can organize his practice as an LLC in Illinois. The only prohibition in setting an LLC to practice medicine found in the Illinois LLC Act is that all organizers of the LLC must be either physicians or lawyers retained by the physicians to set up the LLC. See 805 ILCS 180/5‑1(a). Additionally, Section 225 ILCS 60/22(14) of the Illinois Medical Practice Act holds that a physician can be disciplined for entering into an association with non-physicians where revenues from the practice of medicine are shared. Thus, if your LLC will share revenue generated from the rendering of medical services performed by a physician, then I believe all LLC members must be physicians. Can you form an LLC with yourself (a licensed physician) as the sole member? I do not see a problem with that in regard to the two rules mentioned above.
