Question: can someone get a green card if he's staying illegal in the US for around a year, but his Mom has sponsored him for a green card and the date has arrived to file for the green card. And if not what is the procedure that he should follow in order to get the green card, and will he get punished for staying illegal for a year? and how long does it take to get his green card? and will he be able to enter the US ? by the way he was over 21 when him mom filed for his green card.
he was following what the paralegal who helped him file his case to stay in the U.S. to get better chance for the green card. he didn't know he was illegal staying until now--which might have been 1 year since the company terminated his H-1B.

It is extremely difficult to give accurate information over a forum like this because there are so many factors surrounding a case like this. Even how much time something will take can vary among areas of the country. I recommend obtaining the services of a qualified attorney. You should also never listen to a paralegal as they are not able to give legal advice and for them to dispense legal advice is generally a violation of the law.
