Question: I want to marry a illegal mexican that got caught at border. He was finger printed but I was told it may not be in system that he was sent back. A lawyer told me that. We are in love. I am a middle class american and independent woman. I dont want to be in the category of most relationships in this nature. Can we get pass the bar if he is on record? I cant go without him 10 years. I can do 1 year for process papers. Please help answer my question. Thank you.

Response: Hello Tanya-

You face a problem that is very common. I would need to know more about the contact with Immigration in order to determine what bar is there and if it is waiveable. I would also need to know all the times he has gone in and out of the United States. All of this is important to determining what your situation is ultimately. The worst-case scenario is that there is nothing that can be done for 10 years, as you indicated. The best-case scenario is that he would come back in a few months. But without being able to ask you many questions about what happened I would only be guessing, and that does not do anyone any good.
