Question: What are the possibilities of my husband getting his green card if I continue with the process. He has no criminal backround and has only been here once. Will he get send to Mexico for the Pardon?

Response: Hello Alejandra-
You seem to be referring to the I-601 waiver process. If your husband has only entered the United States one time and has no criminal background he stands a very good chance of getting approved. Ultimately it will come down to a hardship packet that you submit to Immigration when he goes for his interview in Mexico. A well-written hardship letter and packet will virtually guarantee that your husband will get his green card. He can expect to be in Mexico anywhere from a couple of days to 2 months at this time, but that may change in the future. Because of his unlawful entry this is one of the only chances he has at the moment to get a green card.
Please let me know if you have any additional questions. Immigration is Federal law therefore the laws in Oregon are the same as in the rest of the United States. I often deal with I-601 waivers and know that my clients have many doubts about it but I can tell you it does work!
